Competence and compliance

A key area of the Building Safety Act is to address the competence of the individuals carrying out design, construction and refurbishment work.

It is the principal contractor’s objective to deliver a product that exceeds the client's expectations and requirements, while demonstrating compliance with Building Regulations. This is achieved by maintaining high standards of quality throughout the construction process, by managing the quality control process, conducting the required inspections, recording evidence and ensuring compliance with the relevant regulations and standards.

Plan, manage and monitor works 

Everyone who has a stake in the project has a duty which is to undertake work for which they are competent. There are specific Duty Holders; Client, Principal Accountable Person, Principal Designer, Principal Contractor, Designers and Contractors. These duties include having arrangements and systems in place to plan, manage and monitor both the design work and the building work to ensure compliance with Building Regulations and The Construction (Design and Management) Regulations.  

Compliance  

The duty to ensure compliance with Building Regulations remains with those who produce the building work and those who have key roles in the design and construction process. The duty holders will be required to cooperate with other duty holders by coordinating their work and providing information.

Enforcement and penalties

Demonstrating compliance is now more important than ever. The BSA includes the implementation of more stringent penalties for non-compliance with Building Regulations. These include fines and potential imprisonment.

The Building Safety Regulator now has enhanced powers to enforce compliance and will take action against duty holders and building owners who fail to meet their obligations.
